Terms of use
Last updated 30 October 2026
These terms explain the rules for using businessquest.co.uk, our client portal and the website features made available by Business Quest. Please read them before creating an account or starting an assessment. Paid work is also governed by the separate agreement described below.
1 About Business Quest
The website is operated by BUSINESS QUEST LTD, trading as Business Quest, a company registered in England and Wales under company number 17376281. Our registered office and correspondence address is 128 City Road, London EC1V 2NX, United Kingdom.
You can contact us at policy@businessquest.co.uk or +44 7348 556953. In these terms, "we", "us" and "our" mean BUSINESS QUEST LTD. "You" means the person using the website and, where that person is authorised to act for an organisation, that organisation.
2 Who the services are for
BHGI, the Business Health and Growth Index, helps organisations assess business performance and identify priorities. BTIO, Business Transformation and Intelligent Operations, supports agreed operational improvements. The Business Quest Game is a learning and discussion tool. The website also provides information and recruitment opportunities.
Our business services are offered for business or professional purposes, not personal or household use. You must be at least 18 to create a business account, submit an assessment or register for a business session. You must have authority to provide information and act on behalf of the organisation you represent.
The current service focus is businesses operating in England and Wales. An enquiry from another location is subject to our confirmation of eligibility and availability. Submission of a form does not guarantee acceptance of an engagement. Any mandatory rights you have as a consumer are unaffected; describing a service as business-only does not remove rights that apply by law.
3 Website use and paid service agreements
These terms govern website and portal use. When you create an account or start an assessment, we ask you to accept the applicable version. A general enquiry, invitation or automated acknowledgement is not acceptance of paid work.
Before paid BHGI work, an Expert Review, BTIO or a paid workshop begins, we will provide a written order confirmation, proposal or service agreement setting out the customer, scope, fees, payment stages, expected timetable and relevant cancellation terms. A paid engagement is formed when that written offer is accepted through the method it specifies. An Expert Review is human review of an agreed assessment; it is not a separate scoring method.
The accepted service agreement takes priority for the paid work if it conflicts with these website terms. A data processing agreement governs processing carried out solely on the client's instructions. Our Privacy Policy explains personal-information handling; it is not blanket consent. Nothing in these documents overrides rights or duties that cannot lawfully be excluded.
4 Accounts and access
Provide accurate contact details and use an email address you are entitled to use. Keep your sign-in details and invitation links secure, do not share an account, and tell us promptly if you suspect unauthorised access. Your organisation should inform us when a person's access needs to change.
Access is limited to the permissions assigned to you. You must not use another person's account, attempt to view another client's information or bypass a restriction. An administrator's ability to assign work does not itself give authority to change respondent answers, approve a report or accept a contract on another person's behalf.
5 Information and evidence you provide
Answer honestly and to the best of your knowledge. Use "I don't know" where available rather than guessing. A "Not applicable" response is subject to the assessment's applicability rules and any required review. Tell us if an answer or document is inaccurate or becomes materially out of date during the work.
You must have the right and a lawful basis to provide uploaded information, including information about colleagues, customers and suppliers. Share the relevant privacy information with people whose details you provide, where required. Remove unnecessary personal information and do not upload confidential material in breach of another person's rights.
Do not upload passwords, payment-card details, information about children, criminal-offence information or sensitive personal information unless we have specifically agreed a lawful and secure process. Use the agreed upload route. We may restrict or remove unsafe or unlawful content and ask for a suitable replacement.
You and your organisation retain your rights in the information you provide. You give us the limited permission needed to store, reproduce, analyse and share it with authorised people and providers to deliver, support and protect the agreed service, subject to the Privacy Policy and any data processing agreement. This is not permission to sell your data or use identifiable information for unrelated general-purpose AI training.
6 How BHGI results should be understood
BHGI uses a controlled question set, applicability rules and defined scoring methods. Results depend on the assessment version, scope, answers and evidence available at the time. A score is an indicator of assessed business maturity, not a guarantee of financial health, legal compliance, investment readiness or future performance.
AI may assist with interpretation and report drafting where that feature is enabled. It does not independently alter respondent answers, scoring rules or calculated scores. AI-assisted text can be incomplete or wrong, which is one reason human judgement and review remain important.
Our pilot is still being evaluated. Reports distinguish the health score from evidence coverage, confidence and risk indicators. A low score or an uncertain answer does not, by itself, establish wrongdoing, insolvency or a critical risk. A clarification or review may be needed. A report described as reviewed or verified only has the checks expressly stated in its scope; it is not an external audit or regulatory certification.
7 Review and release of reports
Paid reports require human review and approval before an authorised administrator releases them. Payment alone does not approve a report. Free, sample and preliminary outputs are limited to the scope stated and must not be presented as a full verified assessment.
If important answers, collaborator input or evidence are missing, we may request clarification, pause review or issue a clearly qualified or provisional output where appropriate. We will explain the gaps and any effect on coverage or confidence. We will not describe missing information as verified, and we may withhold a final conclusion that cannot reasonably be supported.
Any review timetable is confirmed for the engagement and depends on receiving the required information and responses. Tell us promptly if a released report contains a factual error. We will assess the issue and, where necessary, issue a corrected version with an appropriate revision record.
8 Professional judgement and BTIO delivery
Website material, BHGI results and the Game support management discussion and decisions. They are not legal, tax, audit, investment or other regulated professional advice. Seek a suitably qualified adviser where a decision requires that expertise. Reports must not be used as the sole basis for employment, credit or another decision with significant effects on an individual.
BTIO work follows an agreed scope. The engagement identifies the project lead, responsibilities, milestones, dependencies, fees and change process. Dashboard status, progress percentages and comments are management records, not automatic acceptance of a deliverable or authority to increase scope or cost.
Your organisation remains responsible for its management decisions, staff, lawful operations and approvals. We remain responsible for performing our agreed work with the care and skill required by the service agreement and applicable law. We do not guarantee a particular revenue increase, funding award, cost reduction or commercial result.
9 Prices and manual payments
A BHGI Quick Check is free where it is identified as free. Paid assessment work, Expert Review, BTIO and paid sessions require a separate written quotation or order. Prices are in pounds sterling unless the written agreement states otherwise. The quotation or order will state whether VAT applies and show the total payable before you commit. Website "from" prices are indicative, not a promise to deliver any requested scope for that amount.
During the pilot, payment is by invoice and the bank-transfer method specified on the invoice. We do not take online card payments through the website. Verify any unexpected change to bank details with us using a contact method you already trust.
The written order identifies when payment is due. We may wait for cleared payment before starting paid work or releasing the approved report, unless an authorised payment waiver, assisted-pilot arrangement or staged-payment plan has been confirmed in writing. Submission of an assessment does not create an undisclosed payment obligation. There is no automatic subscription or renewal merely because you create an account or complete an assessment.
10 Cancellations and refunds
Contact policy@businessquest.co.uk promptly if you need to cancel, reschedule or query a payment. The applicable notice periods, charges for work already performed and any refund entitlement will be set out in the accepted service agreement before you commit.
An authorised Business Quest administrator reviews cancellations, waivers and refund requests and confirms the decision in writing. That internal approval process does not limit a refund or other remedy required by law. We do not apply a blanket "no refunds" rule, and these website terms do not create an automatic cancellation fee. Any consumer cancellation rights that apply by law are preserved.
11 Our materials and your report
The website, brand, question bank, scoring framework, software, templates and Game materials belong to us or our licensors. Unless your service agreement states otherwise, you may view the website and keep reasonable copies for your own legitimate business use, but must not resell, republish or commercially exploit those materials without permission.
Subject to the agreed service terms, your organisation may use its delivered reports and project outputs internally and share them with its professional advisers or prospective funders on a confidential basis for the stated purpose. Preserve the report's date, scope, limitations, version and attribution. Do not present a provisional or edited extract as a complete approved report or imply that it is a regulatory certificate or third-party endorsement.
A third party is not entitled to rely on our report as advice addressed to it unless we have expressly agreed that reliance in writing. Any ownership or licence for bespoke BTIO deliverables, third-party software or reusable methods must be addressed in the service agreement. Client information does not become our intellectual property merely because it is uploaded.
12 Acceptable use and confidentiality
- Do not use the website for unlawful, fraudulent, discriminatory or abusive activity, or submit malicious files or knowingly false information.
- Do not probe, disrupt or overload the service, bypass access controls, or access data without permission. Obtain written authorisation before security testing.
- Do not bulk-extract the question bank, scoring system, reports or personal information, or use our protected materials to train a competing system without permission, except where a legal right cannot be restricted.
- Do not publish confidential client or respondent information, or use our name or marks to suggest an endorsement that we have not given.
We handle non-public client submissions as confidential, subject to authorised service delivery, professional advice, legal duties and the applicable agreement. Your organisation must also protect reports, exports and information it receives about other people. The Privacy Policy explains personal-information handling and access within the assessment workflow.
13 The Game and recruitment
Game scenarios and sample reports are illustrative. They are not predictions, a real client endorsement or an offer of funding. A playtest registration does not guarantee a place, we confirm participation and any session-specific terms separately. We will obtain separate permission before publishing identifiable participant images, quotations or recordings.
A job application or talent-pool registration does not create an employment or consultancy relationship or guarantee an interview. Any engagement requires a separate written offer or contract. Recruitment data is handled as described in the Privacy Policy.
14 Availability and external services
We aim to keep the website usable and information accurate, but it may be unavailable for maintenance, security work or reasons outside our reasonable control. Free website features may change or be withdrawn. Any service levels or commitments for paid work are those in the accepted service agreement.
External links and third-party platforms are provided for convenience. We do not control their content, availability or independent terms. Review their terms before using them. This does not remove our responsibilities for suppliers we engage to deliver an agreed service.
15 Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing restricts an individual's statutory data protection rights or any mandatory consumer rights.
For business use of the free public website and its general information only, we are not responsible for indirect or consequential loss to the extent that exclusion is lawful and reasonable. We are not responsible for a loss caused solely by inaccurate information you supply or a decision outside the agreed scope, but this does not exclude responsibility for our own breach of duty.
Liability for paid services, including any agreed cap, is governed by the separate service agreement and applicable law. These website terms do not introduce an undisclosed financial cap, remove an agreed delivery obligation or excuse a failure to use the care and skill required by law.
16 Restricting or ending access
We may restrict access where reasonably necessary to investigate misuse, protect people or information, comply with law, or respond to a material breach. We will explain the reason and give an opportunity to resolve the issue where practicable, unless doing so would create a security risk or breach a legal duty.
Restrictions should be proportionate. Suspending an account does not automatically erase its records or cancel an accrued refund right. Where appropriate, we will arrange lawful access to existing deliverables or an export. Ending a paid engagement and any associated charges remain subject to the service agreement and applicable law.
17 Changes and legal matters
We may revise these website terms. The date above identifies the current version. We will give appropriate notice of material changes and ask for renewed acceptance where needed. Changes do not retrospectively alter an accepted paid engagement or remove accrued rights without a lawful, agreed basis.
These terms are governed by the law of England and Wales. For business disputes, the courts of England and Wales have exclusive jurisdiction, subject to any different written dispute procedure in the service agreement. If mandatory consumer law gives you other protections or a right to use courts where you live, those rights remain available.
If a provision cannot be enforced, the remaining provisions continue to apply where they can operate lawfully. A delay in enforcing a right does not waive it. Contact policy@businessquest.co.uk if you have a complaint or question so we can try to resolve it; doing so does not prevent you from exercising your legal rights.
